Their remit is to ensure the rules have been applied correctly and they go way beyond that in this judgment. If a serial offender like Macclesfield can get away with a disproportionately soft punishment then we can wave the Championship goodbye. The irony of that judgment, of course, is that in bending over backwards to be "fair" to Macclesfield they have condemned Stevenage who have done no wrong. Sounds horribly familiar.
I don't think this panel could reduce the penalty could they? It's in the laws of the game that entering admin is a 12 point penalty - thus the 12 point penalty was enforced. This independent panel can either accept or reject Wigan's appeal. So it will be all or nothing. The Wednesday/Derby/Birmingham debacles are finger in the air because no written rules exist for what the penalties should be.
Yes, the whole "sporting outcome" thing is nonsense. The outcome isn't relegation, it's x number of points off a team's total. They shouldn't be looking any further than that
I didn’t think they could either but not 100% however owt less they may as well just nit impose any points as it makes not one slightest difference and is no punishment .
Straight on the offensive to who? The EFL have issued punishment. It's the EFL's stupid short sighted rule allowing the appeal and possible reduction in penalty that's the problem.
Seems strange that a lot of fans (including myself) are resigned to relegation, when the only views I have heard from independent "experts" suggest that the odds are in our favour. Just watched an interview with Kieran Maguire ("The Price of Football" author), who suggested that he views the appeal 70/30 in our favour. Similarly the barrister on radio Sheffield also appeared quite confident that the result would go in our way.
Do the panel tho have to accept that with Wigan’s appeal being based on “force majeur” that they had to be in agreement that the pandemic is the sole reason for them entering admin? I’m no legal person but with other clubs in the past having 12pts docked for entering administration, they are opening up a can of worms for future appeals based on administration. Don’t every club in the EFL agree to the rules every season? Also isn’t the Macclesfield scenario a totally different scenario with L2 also suspending the current season?
Reason I'm resigned to relegation is I've put myself in a Wigan fans position for a bit. If it were the other way round I'd be seething crying out "double jeopardy". The panel will no doubt think that a points deduction resulting in relegation is harsh and they'll reduce the penalty. That would also give the EFL the get out they needed. Barnsley would go to court be end up with the difference financially from 21st to 22nd.
If Covid is force majeure then Posh have a case that Covid deprived them of their last play off spot . Can of worms but will clubs follow through .
They have the ability to, but I don’t see how they can in practice. You can’t go into administration slightly or have a bit of force majeure. It should be a very cut and dry yes or no.
Not sure I agree. The points reduction would stop a team getting into the play offs or automatic, that's possibly a more appropriate punishment than relegation. What gets me is everyone on here saying we will 100% win, when nobody apart from the panel have the foggiest.
