My fear would be a EFL cop out.. find Wigan guilty but with mitigating circumstances.. so a lower points deduction..
Ok havnt seen the full rules so not entirely sure but what I’ve heard in other posts is that 12 points for admin was set in stone whereas other offences give a variable .
There is no scope for the EFL to apply a lesser deduction at the time the club goes into admin, however the panel can reduce it on appeal: 12.3.18 The League Arbitration Panel shall have the power to: (a) confirm the deduction of 12 points; or (b) set aside the deduction of 12 points and substitute a deduction of such lower number of points as it shall deem appropriate; or (c) order that there shall be no sanction at all.
https://www.efl.com/-more/governance/efl-rules--regulations/section-3---the-league/ There is nothing in the regulations to lower the points reduction. It’s 12 or nothing unless they can prove force majaure. Which they can’t.
See my post above, there is and they absolutely can reduce the deduction. Having said that I consider it unlikely, as a reduction completely undermines the 12 points rule in the first place. As soon as a club is given a lesser deduction it essentially sets a precedent that there is a sliding scale of penalties depending on the club's deemed culpability and opens the floodgates in terms of future appeals.
As I mentioned in a different thread, this is what gives me the most confidence that the deduction will stand - as any other verdict would open the floodgates to such a raft of complications that every subsequent administration case would take months or even years to resolve, not to mention an immense amount of resources.
Nothing, he asked when does a criminal decide his punishment, I replied Wilkes. He asked what would the punishment be and then changed his plea so in essence chose his punishment.
It will be. It's bound to add edge to any future games between us, particularly if within a year or 2.
@mansfield_red is right mate they can reduce the amount of points of the deduction would seem outrageous if so, but ....
If they were to uphold the Wigan appeal, they would place not one, but two clubs in financial difficulty. We would lose millions and would have to adjust, if we were able to, given the 'force majeur' impact of the pandemic on our finances, not just those of Wigan. Also, even if Wigan were given some allowance which kept them in the Championship, what certainty would there be that they would not go back into administration again the following season, as a buyer seems not to have been found. The only way is to apply the sanction in line with the EFL's own regulations and allow Wigan to regroup and rebuild from League One, which is, after all, what several clubs have done in this, or other divisions. Yes, I know that I am biased, but that approach seems to me to be both fair and in accordance with the EFL's own regulations. I do wonder why Wednesday's twelve points were not deducted this season and Charlton Athletic will certainly have something to say about that, as it would have saved their Championship status. Another legal battle there for the EFL to fight.
the reason is because thats when the play off final is, and thats the official end of the season. Nothing more complicated than that. So it will most likely be on Wednesday at some point.
And given our statements over the last few months I believe that we should support / join them - irrespective of the outcome of Wigan's appeal.
