Someone I know is currently negotiating a lump sum and the main part of it is future loss of earnings.

the biggest issue though is that

she was able to achieve such a sum as she was able to afford a top barrister, this would have been out of the range for most people so they would probably end up with a smaller proportionate sum

    RE: No

**** me' I'd end up with an old ten bob note with the pittance i earn if that's the case....

Its a disgrace, how the hell can someone like her have a predicted earnings of £5 million quid, with them lips of hers, nobody would hire her unless it was to advertise Fish products surely....

And also if that husband of hers had a kept his fists (allegedly) to himself she wouldn't have had to visit the Hospital
    In the first place....Its scandalous....

assuming that you personally are fully fit and that you for example earn say, £200,000 a year through your talents, what sort of compensation would you need to put with the pain, lack of mobility, denial of what you previously used to be able to do, personal trauma and the adverse effect on friends and family. plus the cost of extra care, special needs etc.

I get around 23k a year, i order to get close to that as an annuity i'd probably need about 3/4 to a million in a pension scheme. if you don't believe me ask someone.

RE: Bungle's right on this one.

She's got a bit of a gimp. That wouldn't stop her acting. It certainly wouldn't intrude into her career as much as it would say a builder. And if anything is going to stop her securing an acting job it's them ******* stupid lips she had done. Has she actually had a job since she had them done?

Actually, I feel sorry for her. But an error by the NHS shouldn't be worth more to her than anyone else. The ability to walk properly is worth the same to everyone. IMHO and all that.

It's based upon loss of potential earnings though

Strange though, I was at my dads earlier this evening and saw this in his paper (Daily Mail! (doh) ) And it said it was £500k

    Go to the national health

that is funded by, and there for, everybody (when you could have afforded private). They try their best to treat you. Then sue them for £5m (assuming this figure is correct), because you are a high earner. We all lose out from claims like this. Had she insured herself against loss of earnings? No. Had she paid someone to treat her, who would have voluntarily entered into a contract with her and would therefore be financially obliged to pay compensation? No. The claims procedures are there to protect people who cannot look after themselves, not to make the rich, richer.

By the same reasoning as Farnham Red goes into there, it effectively costs more to treat rich high earners, because when it does go sadly wrong, the compensation is higher. So maybe they should have to pay some sort of insurance prior to admission. Richard Branson... whoah! I wouldn't go near him if I was a doctor. Imagine the potential compo.

Sorry, that was dangerously like a Daily Mail rant.

    I lost my dad...

last year through post-operation complications (infections) and the last thing on your mind is compensation. It's difficult to make sense of it all really, apparently there's a 0.1% chance of it happening and you find yourself wondering what sort of ****-up they did make. But ultimately, we have to believe they were trying their best for him, the operation was provided for him, free of charge and in good faith and there were risks involved that were outlined for him. People should remember this before they steam in for compensation. The NHS is provided for us all to help us when needed but they shouldn't be held culpable when things go sadly wrong.

so basically, if you are a "scrounger"....

You don't actually earn anything, so in return, would get bugger all compensation.

Future earnings. Did she have a contract lined up? Couldn't see her getting many well paid parts, with those fat lips that belonged in a freak show.

There will be an element in the final figure that applies to the disability and this isthe same for everyone. (They don't pull the figure out of the air, there's a list.)

The major part of any figure is loss of earnings. This will have been negotiated by professionals on both sides who have a better idea than you or I how much impact her disability will have on her future opportunities.
