The 12 point administration penalty has been in place since May 2013 when it was increased from 10 points and as stated Wigan knew the consequence of going into administration on July 3rd as did the other 23 teams in the League.
they are plaing on the loophole of force majeur..... and knowing the form of the EFL they will get away with it. Many decades the governing body of English football shafted us when the elected Arsenal to the top flight above us, even though we had finished above them...... we are not wanted and as such will be shafted yet again.
Fortunately Barnsley never had to seek re-election to the Football League where clubs in the bottom 4 had to re[apply for League status and club chairmen used to vote on who should remain in the League and there was a reluctance to vote for non League teams. In 1914 it was the club chairmen who voted Arsenal into the top flight even though they finished 5th shafting ourselves as well as Wolverhampton. There is a power imbalance between clubs and Man City won their recent appeal at the Court of Arbitration . An appeals procedure is required in any human governance.to ensure democracy and openness On the pitch the players were fully motivated and deserve to play Championship football next season. Lets see how events unfold but if there is no substance and certainty in the EFL rules integrity will be questioned and it is important natural justice and fairness are demonstrated on all occasions . I'm sure the club will not be passive if Wigan receive a favourable judgement.
