The law states that if a person is too intoxicated to make an informed decision and the other person or persons involved are aware of this then whether the person consents or not they are not legally able to do so therefore the sex will always be non consensual. So it this case. Evans was aware that the very young woman was drunk as evidenced by the CCTV pictures of her and chose to have sex with her regardless of the fact that he was aware that she could not make an informed decision.
No that's not quite what I said (regarding your second point). I think what he did was morally reprehensible but that alone doesn't make him a rapist however the evidence in the case was strong enough to convict him.

If that's a dig at my post, it's a rubbish one. I said it wasn't in reference to her, and also wearing a short skirt is not the same as actually saying yes, or, infact, literally asking for it. To clarify, I said if someone knowingly, and intentionally, gets so drunk that they cannot remember anything, and asks someone to have sex with them, they shouldn't be surprised/try to prosecute the guy if they do. Once again, I am not in any way stating that is what happened in this case.
The guy she went back to the hotel room with was found not guilty. Ched Evans entered the hotel room, saw his mate ******* her and then had a go himself. They'd never met before. She definitely didn't ask Ched to have sex with her. The best either of the lads came up with is she said 'yeah' to being asked. The girl believes her drink had been spiked as she has no memory of the night, so she didn't knowingly or intentionally get so drunk, according to her testimony. I don't believe she tried to prosecute anyone (could be wrong). The police interviewed all parties and suspected a crime had taken place. The crown prosecution service obviously agreed and it went to court.
From what I remember the woman was 19 and got drunk with Evans mate and went back to mates room for sex. Then Evans mate texted him and said he'd got a bird and did he want a go. So Evans pops round for his turn. The girl has no memory but I think it was filmed on a mobile. There is no doubt she wasn't in a fit state to consent which was Evans defence that she said yes
About 19 as I remember it. It's the same part of the law that deals with consent from say underage girls or from those with diminished mental capacities. In one of my first jobs in London I worked for child and protective services. On Mondays I was basically responsible for finding out where the weekend absconders from care were. Now I was young and fairly naive and sone of the girls were pretty street wise and basically out all weekend up to all sorts I saw one of these girls after she has got drunk beyond compare and been raped the guy said this 13 year old girl ( he was 16) had consented I remember being so glad when the law changed.
As I've not said twice, that statment was not in any way connected to this case. I know that the example I gave is not similar to this one, it just got me thinking about girls who get purposefully paralytic on nights out.

As I understand, it was filmed on a mobile through the hotel window by Evans' brother, Evans having tricked the receptionist into letting him have a key for the room, which he let himself into whilst his mate was mid-shag, Evans then 'joining in'. What part of all that is any way right? I have a wide circle of friends and enjoyed my time being a single young man in London in the mid 90s, but this kind of thing is several levels below anything that anyone I know would have got up to.
I don't understand why all the guys even wanted to? Why would you want to film your brother having sex with someone? And why would the 'mate' want someone to come around and join in when he's with a lass? Surely he'd have told him to **** off. It all just seems a bit weird.
Symptomatic of the times I'm afraid. The oversexualisation of youth culture leading to unrealistic expectations for kids growing up. For example, I understand that the younger generation's view on pubic hair matches that of the porn industry! Then again, there's a correlation between what passes as a pop video and the porn industry these days. And a 'leaked' sex tape nowadays is a career move. And young footballers' behaviour can be nothing short of shocking at times, hence the increasing amount that are caught up in this kind of thing. They're adulated from the age of 16, paid amounts you or I can only dream of and are not used to hearing the word 'no'. They have too much time on their hands and think they're invincible. Unfortunately, footballer's wife seems to have become a career option of choice nowadays, so there are plenty of people queuing up to feed this bad behaviour. When I think of the kind of things that caused scandals in my youth in the 80s I shudder to think of what Mary Whitehouse would say nowadays. We had things like the outrage of Robert Palmer's pop video or Jeffrey Archer sleeping with a prostitute. Or footballers sleeping with directors' wives. Actually that last one is a bit close to home!

Two men one woman - not necessarily a generation thing but rather something which appeals to bisexual or gay men. The question of consent in rape cases is complex - someone may be happy for certain things to happen but not consent to other things. Clearly the jury in the Ched Evans case believed the girl when she said that something that she had not consented to had happened. The bottom line is the guy was convicted of rape and therefore should not play professional football again. If he appeals and wins then I see no reason why he can't.
The idea of a threesome isn't weird if you were all involved in choosing each other, but filming your brother, and letting your mate just tag along is.
