RE: how did you make that jump? Racially motivated assault. It's what two of them were arrested for. If I had been, then I'd be suspended pending an investigation. Making a simple point, that's all.
gross misconduct / assault Assault has generally been considered by courts/tribunal as a serious breach and think it would be fair to say that a lot of employers would suspend on full pay as a result and the employee would have little redress . However, as far as I can see , the world of football doesn't seem to reflect most employment laws and it wouldn't really be in the clubs (or anyones interests) to suspend them on full pay whilst investigating the incident I wouldn't have thought!
Mine has this ..... The Company may summarily terminate your employment without notice or payment in lieu in cases of gross misconduct. Listed below are examples of circumstances that are normally regarded by the Company as gross misconduct (the list is not exhaustive): ... conducting yourself either during or outside normal hours of work in such a way that the interests and reputation of the Company or any other member of the XXX Group, its employees or any of its or their clients or customers are, or are likely to be, jeopardised or adversely affected; ....
yes suspend em lets set a prescedent then in future every team thats got a key match coming up can report the oppositions star players and get em banned.Kin ell which planet do they get these journalists from? or was the reoprt initally written in crayon and marked by the teacher first!!!
Cant see the dilemma I would be playing them up to them being found guilty by a court of law. Even if they are charged and taken to court it doesnt mean they are guilty. For there to be a breach of criminal law there needs to be a guilty verdict, not just allegations and possible charges. And even if they are found guilty I still wouldnt sack them. Make them do some community work or something instead, if we sack them they will only be taken on by another club so who is being punished, other than BFC and its fans.
There are also differences between normal jobs and this. If you are suspended then your employer can bring in a suitable replacement/temp to cover your job. The club cannot do this because of the transfer window, so would effectively be damaging themselves without any proof of guilt.
I have no idea what you're all on about. But I do know that gross misconduct is like normal misconduct before tax. I also think that the players should be loved with railway sleepers. If they turn out to be innocent - we just say sorry & everyone is happy. There we go.
