I've got a chance to go on a school trip to Italy

    The countryside around Dodworth is fantastic for dog walking.

    Not really.

    The main problem is that Laura has to take lots of medication for the illness(es) she has, all of which has to be specially made up as none of it is medication even hospital pharmacies stock. She would need a suitcase just to carry enough medication for the trip.

    If Laura lost or broke any of these medicines or for some other reason didn't take them whilst away, she would soon end up either in hospital over there, or be sent home to a hospital over here (tying up a member of staff).

    The school and the LEA don't want to compromise Laura or the other children going and therefore couldn't sanction getting the additional insurance clearance required (if it was possible to do so) and also sanction extra staff to go, just in case.

    Obviously Laura is disappointed, but has grown up knowing that she can't always do things that "healthy" people can. This has made her more determined to push herself so that, when she's older, she can do what suits her.

    Yes IMHO

    If we treated somebody at work like that we would have a solicitor waving the disability discrimination act at us and asking for a large quantity of money.

    But then again if we sent a disabled or ill employee on a foreign trip and something went wrong, we would have a solicitor waving the health and safety at work act at us and asking for a large quantity of money.

    Easy to decide isn't it?

    Not under DDA anyway.
    DDA says that offering someone with an impairment/ disability a lesser service is unlawful except in some circumstances:- (Cost, service to others, safety being the main ones). Probably the key one is that by offering a service to one person, it would be to the detriment of a larger group. From what Crystal has said I'm sure the powers that be could argue that the risk of removing a teacher to look after Laura (worst case scenario), would cause a hugely detrimental effect to the larger group. The Act is full of "get out clauses". It's a real shame for Laura.
