This is incorrect. You can be questioned under caution without being arrested, or indeed placed in custody, in Scotland just as you can be in England.
As I posted earlier by agreeing to be arrested it saves a lot of time, time spent on applying for court orders, orders which are subject to time limits which puts a time scale on their investigations see previous post ..it is also seen as cooperation on the part of the individual, by agreeing to be arrested it also clears the police further down the line of ending up in court on defamation of character for any wrongful arrest...
Just been on the Scottish news. Nicola was invited by the police to attend a police station and be arrested and subsequently interviewed.
Unfortunately it's not that easy and everything has to be done lawfully and above board. By agreeing to arrest the police have automatic rights to access all her accounts not just the ones she presents In her defence, by doing so it goes a long way to show she's got nothing to hide and that's she cooperating The Tory press will be lapping it up, keeps Boris of the front page...and water downs their embarrassment and then helps hide the truth of what's taken/ taking place in Westminster
So in essence it’s in her interest to agree so she can’t be accused of trying to hide something in that example?
