Totally agree. He's outside a locked door with a gun in his hand. He shouts to his girlfriend to call the police, safe in the knowledge that he has the 'intruder' under control. His girlfriend shouts 'What you on about you daft get?' (She's got some Tarn in her ) from the bathroom and the situation is resolved. Seemples! Or in other words what the fook are you doing shooting at people through a locked door when there's absolutely no need for it at all. Of course he's chuffin guilty how can he possibly be anything else? The sickening thing is he's going to get away with it because of who he is.
I think it's like someone deliberately driving onto the pavement and running people down. That's murder isn't it? If the person stood at the bus stop who you've just killed turns out to be your girlfriend it is still murder
no one is denying hes guilty oscar himself has admitted it. but is he guilty of cold blooded murder or of the lesser charge thats the question. I wonder if he gets charged for the higher offence and its proven he didnt cold bloodedly kill her would that result in him getting off with it.
That's what I'm thinking. He's charged with committing a specific, premeditated crime - a very difficult one to prove. If I were a conspiracy theorist, again bearing in mind who he is, I might think that charge had been very carefully and deliberately made.
The charge he has been charged with is the right one under South African law. Regardless of who was behind the door the prosecution claims that by walking to his bed, turning and walking to the bathroom before shooting then the shooting was premeditated. ie he decided to murder someone while going for his gun. It wasn't heat of the moment because he actually went to get a weapon. I think that the name of the victim is largely irrelevant as he quite clearly intended to murder somebody and he admits it was premeditated.
the judge has said super tyke that if he feels he will leesen the charge, we will find out tommorow. But if he doesnt and at trial they cant prove it was cold blooded.Would he get off with it

MR C its also to decide what to charge him with, if the prosecution want the higher charge which the judge has accepted,but has said if the defence can convince him it wasnt cold blooded he will lessen the charge and grant him bail. The higher charge doesnt have a bail term.

Wont there be some quite clear evidence whether she was in the bathroom hiding from him or was in the bathroom doing a number 2 at the time? I'm pretty damn certain that she won't have flushed the toilet after being shot in the head whilst sitting on it.
I thought (and still think) that OJ Simpson was as guilty as sin but for me Pistorius takes guilt to a different level.
I don't know about SA law but in this country there has to be certain 'mental' elements for it to be murder. Murder is very difficult to prove beyond all reasonable doubt. Have a read around, you will be shocked at some of the crimes that have been reduced from the murder charge to manslaughter instead. Try R v Hancock & Shankland for a start. To me dropping a concrete slab from a bridge onto a car could be argued as murder, but these guys had it reduced on appeal.
