Should making a joke, no matter how offensive result in you being jailed?

Inconsistencies are frustrating. Today a lad guilty of posting grossly offensive stuff about soldiers has been let off with a community order. How can wishing death on soldiers and possibly inciting racial tension be less of a crime than a sick joke about a girl? We've all heard sick jokes and I would imagine most of us have shared the odd one. Very few I would imagine have wished death on people. Crazy world.

Technically - they couldn't lock me up ...

    ... as I was hungry.

That would stand up in a court of law that would.

it's designed to put fear into the general public. "Watch what you say, we are listening". Of course at the moment it only applies of your say something about someone in the public eye, Patrick Muamba, an abducted child, Tom Daley etc..

It's ****ing ridiculous and very, very worrying.

unless your in the money and can frighten the authorities with an expensive day/days in court thats your lot.
the lad was a 19 year old di k hed who should've been named and shamed in his community, end of.
sick jokes about the moors murders etc were going about in my day i just treat them and the peope that told them with the contempt they deserved surely. people can see what sort of people are doing this and make their own minds up are we to start a witch hunt for all the reds fans that sang the red suspenders song etc.
i can see the day in the not too distant future where kids will be encouraged to report their parents for having a different view to the authorities. sound familiar.

If he'd have said "I hope Afghans die and go to hell" do you think it would even got as far as the police speaking to him? I don't, he was dealt with in this way because he was speaking about "our boys".

Very. There's not much difference between saying what he said and being locked up for making similar comments about politicians.

Should you go to jail for a joke? No
Should you go to jail for attempting to abuse people who are are still looking for their missing child?
There are no jokes about a child been abducted/murdered. The point I think that has been missed on here, is that certain people use the internet type vile and abusive statements to gain a reaction, then claim freedom of speech, while hiding their identities. These trolls deserve punishment, this particular fool just used his own name.
If you put yourself in the position of losing a loved one, then think how you would re-act if someone abused you face to face in public for a "joke", you are honestly telling me you wouldn't want to either fight or have the police fight for you?
If so? What other punishment is left other than jail?

Jail isn't the only punishment available. A community punishment would have been very appropriate in this case. Get him working with victims of crime or something similar.
