thats true but under the road traffic act there are various exceptions the cps can use and still prosecute
not sure about this 3 month rule they must give you a notice of intended prosecution within 14 days however, if they fail to do this it is not a strict defence to the offence. they can argue for example that they took reasonable steps and made reasonable investigations to find the owner and can still bring a prosection. once you have received the NIP they have 6 months to prosecute
not yet i got one 13 days after i was flashed,gutted when i opened the envelope.If it,s after 14 days though it,s like a dud firework throw it away!
Didn't see the original thread so don't know about your flashing incident, but I always thought that the camera had to flash twice to prosecute you, so that they can dtermine the distance travelled over a set period of time, single flash generally indicates no film in the camera.
They have 14 days to issue a NIP NIP = Notice of Intention to Prosecute If your car is registered to the correct address and you haven't got anything after 3 weeks (allowing for the post to be particularly *****) you can breath a sigh of relief
A Ray of hope According to this speed camera info site, A Gatso can only take 400 piccies before the film runs out. I suspect that it will continue to flash after that, but it can't actually take the pictures until the guy in a van comes and changes the film.
