I'm not talking about the statement today but on the 3rd of December Paul Conway was quotes as saying "if anybody else is tampering with our rights, we are going to expect compensation. Hearts have our letter" and "they either pay us now or we will file a claim against them. And if any club wants to fight it, we will win." Tampering is the American word for tapping up. Don't you think that is accusing hearts of tapping up? Hearts seem to believe that's what it meant
Conway is suggesting that because Stendel is not free to leave because he is still under contract to us (or whatever bizarre phrase he used), they (Hearts) ARE tampering with our staff.
As kektyke has just said. Hearts have a letter probably relating to legal proceedings to recover compensation we believe is due ( Hearts obviously don’t). Any club that tampers with our staff will also be persuaded.
Quote from BFC Statetment "After two months of unproductive discussions (and the subsequent public announcement by Heart of Midlothian that he has joined them as their new manager), the Club cannot wait any longer in speaking to its fans. More recently we have attempted negotiations of a settlement with Heart of Midlothian Football Club for the services of Mr. Stendel, Chris Stern, and Dale Tonge to no avail." From Hearts "On behalf of the Board of Directors of Heart of Midlothian Football Club, we would like to reassure our supporters that we have followed all proper procedures in appointing Daniel Stendel. He was not an employee of Barnsley Football Club when we first consulted him and there is no basis on which Heart of Midlothian Football Club is liable to Barnsley Football Club. Misleading reports and statements to the contrary elsewhere are entirely false. Should any claim be commenced against Heart of Midlothian Football Club, it will be defended in the strongest possible terms." So there are 2 issues, the 1st that DS was being tapped up by a Championship club and then spoke to Tonge and Stern about going with him and the club finding out and placing him on Gardening leave and the 2nd issue is with Hearts of compensation we believe they owe us for the remaining months of DS contract
But they are not tampering if they firmly believe that DS was free to join any club, regardless of what Conway says if Hearts have seen legal papers/contracts to prove it. Also Stern and Tonge have been released from their contracts so are free to join any club the issue is solely around DS and whether he was sacked or placed on Gardening Leave
Oh you think they were completely unrelated words? You think they were saying hearts owe us compensation and in the same sentence were talking about completely unrelated subject of tampering?
No, as i have just replied to Fired. If Hearts have seen legal papers/contracts that prove DS was free to join then they are not Tampering in their view
Yes but you have to accept that we DID accuse them of tampering in the interview Conway gave last week right? Now I've no idea if he was or wasn't under contract at the time but surely it has to be accepted that is what Paul Conway was saying right?
SuperTyke isn't claiming they are, he's claiming that Conway has accused them of tampering. And having read what he said I agree with him.
Barnsley Football club at times make me sick.. No matter who it is that leaves the club.. its never ever the clubs fault. Plus there's always a concerted effort for them look to be the biggest tw@ts under the sun..
Yes that's what I'm getting at. On the 3rd of December he said (to the Scottish media) "if anybody else is tampering (American word for tapping up) with our rights, we are going to expect compensation. Hearts have our letter" and "they either pay us now or we will file a claim against them. And if any club wants to fight it, we will win."
I understand why Hearts think that they are not tampering, I'm pointing out that Conway insists that they (Hearts) are because he believes Stendel is still contracted to us. Someone has got it wrong.
Bit like the Bosman ruling -The Stendel Ruling has a nice ring to it and the barnsley fc name will be forever stamped into footy law when they get the ruling on this no doubt - it could be described - unlawful to permit an employee to attempt to gain employment elsewhere once they have been relieved of duties and placed on gardening leave. This could drag on years.
Is that tampering in the same way you lied about the tampering of that video yesterday? Still waiting for a reply
