    You would think in most cases there would be some prior

    evidence of abuse, cops called or some physical signs of abuse over the years. I would doubt the situation you've mentioned would happen too often. Anyway, vindictive accusations happen with other stuff anyway, rape accusations, child abuse accusations but you wouldn't remove those from being a crime because of it.
