Employees with parental responsibility for a child under 6 or under 18 if the child is disabled. Those with 'parental responsibility' include parents, foster parents, adopters and guardians. The right also extends to partners of such who are living with the child; and who have completed 26 weeks continuous service at the date of the request to work flexibly. What is the right? to apply to work flexibly (ie to vary the terms and conditions of employment) in order to care for a child. the employer is under a duty to consider the request seriously. the right is a procedure to consider the request. Flexible working cannot be imposed by an employment tribunal.
